TO ENTER: First, use your web-enabled mobile device to scan the QR Code appearing on a printed Promotion advertisement, which will launch an online entry form (“Entry Form”) on your device. Then to complete your entry, fill out the Entry Form including the requested contact information and submit the completed Entry Form so it is received by Sponsor’s server during the Entry Period. Scanning a QR Code itself is NOT an entry; follow the Entry Form’s on-screen instructions to complete your entry. To access the Entry Form via a QR code, your mobile device must have a camera and QR Code reading application installed. QR readers may not be available through all wireless carriers or on all web-enabled mobile devices. Installation of a QR reader is subject to your mobile device’s compatibility. Sponsor/Administrator is not responsible for any QR Code reader website, download, claim or otherwise related to the entrant’s attempt (successful or otherwise) to install a QR Code reader. Sponsor/Administrator do not endorse any particular QR Code reader or company products, and any such download is at the sole risk of the participant. You are solely responsible for any related equipment, application, and wireless charges pursuant to your wireless service provider’s rate plan. Completing the online entry form also constitutes your willful agreement to opt-in to Sponsor’s email marketing list. You may opt-out of the list at any time by using the “unsubscribe” link which will appear within each of Sponsor’s email messages. If you decide to opt-out, this will not affect your ability to enter a Promotion or your odds of winning a prize in a Promotion.
Note that there are two categories of QR Codes: (a) QR codes appearing in printed Promotion advertisements which do not appear within a Boost Mobile store (each a “Non-Store QR Code”); and (b) QR codes appearing in printed Promotion advertisements which do appear within a Boost Mobile store (each, a “Store QR Code”). There is a limit of (1) entry per person/email address for entries entered via a Non-Store QR Code, plus (1) entry per person/email address for entries entered via a Store QR Code. See Section 5 below for a list of participating Boost Mobile locations where Store QR Codes will be available to scan during the store’s open hours within the Entry Period.
Multiple entrants are not permitted to share the same email address. Entries are void if late, unreadable, inaccurate, incomplete, tampered with, forged, mechanically reproduced, irregular in any way or otherwise not in compliance with these Official Rules. Entries submitted in excess of stated limits will be void. Use of any automated system to enter (as determined by Sponsor/Administrator in their sole judgment) is prohibited and will result in disqualification at Sponsor/Administrator’s sole discretion. Any attempt by any entrant to obtain more than the stated maximum number of entries by using multiple/different accounts, identities, registrations, or logins, or through any other methods, may void all of that entrant’s entries and that entrant may be disqualified. Sponsor/Administrator are under no obligation to correspond about entries, nor are Sponsor/Administrator required to acknowledge its receipt of entries. WINNER NOTIFICATION AND GENERAL PRIZE RESTRICTIONS: The name and city/state of a potential winner may be announced online prior to verification; however, any such announcement is not a guarantee of eligibility. A potential winner will be notified by Administrator or Administrator’s designee by email at the email address provided at the time of entry, and/or by phone call/voicemail and/or text message to the phone number provided at the time of entry. Any such notification will instruct the potential winner to reply as specified within three days after the time that the notification email was sent. A potential winner must reply as instructed to confirm their eligibility and ability to accept the prize, and provide their complete contact information within such three-day period, or they will be disqualified. Entry must be made by the entrant and via the means described in these Official Rules. You are not a winner until your entry has been verified and you have complied with these Official Rules. If any provision of these Official Rules is found to be invalid or unenforceable by a court of competent jurisdiction, such provision will be severed from the remainder of these Official Rules, which will otherwise remain in full force and effect. Sponsor/Administrator’s failure to enforce any portion of these Official Rules does not affect or waive Sponsor/Administrator’s right to enforce any portion of Official Rules at any time. Headings and captions are used in these Official Rules solely for convenience of reference, and shall not be deemed to affect in any manner the meaning or intent of these Official Rules or any provision hereof. When terms such as “may” are used in the Official Rules, Sponsor/Administrator has sole and absolute discretion. Entrants agree to waive any rights to claim ambiguity or any deficiency in these Official Rules or in any Promotion, including its administration.
Entrants further understand and agree that all rights under Section 1542 of the Civil Code of California (“Section 1542”) and any similar law of any state or territory of the United States that may be applicable with respect to the foregoing release are hereby expressly and forever waived. Participants acknowledge that Section 1542 provides that: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.” The releases hereunder are intended to apply to all claims not known or suspected to exist with the intent of waiving the effect of laws requiring the intent to release future unknown claims.

PUBLICITY: By participating, you grant to Sponsor and its affiliated companies the right, except where prohibited by law, to use your name, likeness, picture, address (city and state), voice, biographical information, and written or oral statements about a Promotion or Sponsor’s products/services (the “Materials”), for advertising and promotional purposes in promoting or publicizing Sponsor, its affiliated companies, and the products or services of each, in any and all media without limitation as to time or territory, without compensation unless required by law. DISPUTES: By participating in a Promotion, each entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with any Promotion, or any prize awarded, must be resolved individually, without resort to any form of class action, and solely and exclusively in the applicable state or federal court located in or nearest to Littleton, Colorado, and each entrant submits to sole and exclusive personal jurisdiction to said courts in the State of Colorado for any such dispute and irrevocably waives any and all rights to object to such jurisdiction; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the applicable Promotion but in no event attorneys' fees; (c) under no circumstances will entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased; and (d) entrants’ remedies are limited to a claim for money damages (if any) and entrants irrevocably waive any right to seek injunctive or equitable relief. Some jurisdictions do not allow for limitations on the ability to pursue class action remedies, or certain kinds of damages, and so these limitations may not apply to you. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of an entrant or the Released Parties in connection with a Promotion shall be governed by, and construed in accordance with, the laws of the State of Colorado without giving effect to any choice of law or conflict of law rules (whether of the State of Colorado or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Colorado.
